The Participant (the definition of which includes all authors and guest authors) guarantees that they have all necessary licenses and permissions to submit this content and have it posted. You confirm that you hold the necessary rights in order to grant a license even if you are not the sole creator and/or copyright holder to the submitted work. When you submit this content (the “Content”) to the What if? | TransCoding project (“What If”), you grant What If, the platforms to which you submit (wordpress, Facebook, etc.) as well as its host and funding institutions, The University of Music and Performing Arts Graz (“KUG”) and the Austrian Science Fund (“FWF”) a non-exclusive, worldwide, royalty-free, sublicensable, transferable right and license to use, host, store, cache, reproduce, publish, display (publicly or otherwise), perform (publicly or otherwise), distribute, transmit, modify, adapt  (including, without limitation, in order to conform it to the requirements of any networks, devices, services, or media through which What If is available), and create derivative works of the Content, including but not limited to the editing and adaptation of the submitted material in the framework of the artwork, research, and documentation in multiple formats, both on- and offline, of the What if? | TransCoding Project (“What If.”)

2. Limitation of Liability

You represent and warrant that you have all necessary rights, licenses, and permissions to grant the above licenses and that the Content submitted by you, and the submission of such Content, do not and will not violate any intellectual property rights (including but not limited to copyrights and trademark rights) of any third party. You agree that you will indemnify, defend, and hold harmless What If, the University for Music and Performing Arts Graz (“KUG”), the FWF and What If’s affiliates, customers, vendors, hosts, officers, and employees from any liability, damage or cost (including attorneys’ fees and costs) from any claim or demand made by any third party due to violation of these representations and warranties, or otherwise arising out of any submitted Content.

3. Exclusion

We reserve the right to exclude Participants who violate the Terms of Participation. Examples of such cases include but are not limited to the Participant making false claims, the Participant not being the rights holder to the licenses for the work, or the Participant violating the rights and/or copyrights of a third party or third parties. By participating in What If, you confirm that you agree to abide by the Terms of Participation.

Note: The English version of the Terms of Participation is a translation for convenience. In case of differences between the German and English versions, the German wording shall be decisive.

Bedingungen zum Aufladen von Inhalten auf diese Website:

1. Urheberrechte und Nutzungsrechte

Der Teilnehmer (alle Autoren auch Guestautoren sind hierbei inkludiert) garantiert, Inhaber der für die Nutzung des übertragenen Video/Musik/Textbeitrages erforderlichen Rechte zu sein. Ist der Teilnehmer nicht alleiniger Urheber oder Rechteinhaber, versichert er, über die für die Teilnahme an diesem Blog erforderlichen Rechte zu verfügen. Der Teilnehmer räumt what-ifblog.net und seinem Team an dem von ihm übersendeten Kreativbeitrag nachfolgende einfache, zeitlich und räumlich unbegrenzte aber nicht exklusive Nutzungsrechte ein:
Recht zur Speicherung der Datei auf einem Server. Das Recht, den Kreativbeitrag der Öffentlichkeit ganz oder teilweise über Facebook und die Website what-ifblog.net, sowie deren Unterseiten zugänglich zu machen (Recht der öffentlichen Zugänglichmachung).
Das Recht zur uneingeschränkten Verbreitung, Vervielfältigung und öffentlichen Wiedergabe des Beitrages (Vervielfältigungs- und Verbreitungsrecht), sowie das Recht zur Bearbeitung des Beitrages im Rahmen eines Kunst-, Forschungs und Dokumentationsprojektes.

2. Haftung und Freistellung
Der Teilnehmer garantiert, dass er keine Inhalte übersenden wird, deren Bereitstellung, Veröffentlichung oder Nutzung gegen geltendes Recht oder Rechte Dritter verstößt. Der Teilnehmer verpflichtet sich, die Kunstuniversität Graz, den FWF, sowie what-ifblog.net und das betreuende Team von Ansprüchen Dritter gleich welcher Art freizustellen, die aus der Rechtswidrigkeit von Kreativbeiträgen resultieren, die der Teilnehmer übersendet hat. Die Freistellungsverpflichtung umfasst auch die Verpflichtung, sämtliche genannten Personen und Institutionen von Rechtsverteidigungskosten (z.B. Gerichts-und Anwaltskosten) vollständig freizustellen.

3. Ausschluss:
Ein Verstoß gegen diese Bedingungen berechtigt das Team sowie die Institutionen von what-ifblog.net, den jeweiligen Teilnehmer von der Teilnahme auszuschließen. Dies gilt insbesondere, wenn der Teilnehmer falsche Angaben macht, nicht teilnahmeberechtigt ist oder eingereichte Videobeiträge geltendes Recht oder Rechte Dritter verletzen. Durch die Teilnahme an diesem partizipativen Kunstblog erklären Sie sich einverstanden mit den Teilnahmebedingungen.
